Michael Valva, 40, and his fiancée, Angela Pollina, 42, were charged with second-degree murder Friday after Valva’s son, Thomas, was found dead on Jan. 17 at the family’s Long Island home. When medics took him to Long Island Community Hospital, his body temperature was 76 degrees, said Police Commissioner Geraldine Hart at a press conference Friday. A medical examiner ruled the death a homicide with hypothermia listed as a major contributing factor.

Police sources say Valva beat the child, then punished Thomas by ordering him to stay in the garage through the night.

By the following day, the 8-year-old was dead. Valva put the boy’s cold body in a warm bath to raise its core temperature, sources said — then told police that Thomas fell on the driveway while waiting for the school bus.
