U.S. District Judge Karin Immergut, who was appointed by Trump in his first term, on Saturday blocked Trump’s call-up of Oregon’s National Guard, saying, “this is a nation of Constitutional law, not martial law.”
The judge’s ruling blocks Trump from sending 200 troops to Portland until at least October 18, stating that there was no evidence that protests had escalated to the level of a rebellion or seriously interfered with law enforcement.
“The President’s determination was simply untethered to the facts,” Immergut wrote.

Portland police officials testified earlier in the week that demonstrations outside of the facility have been largely peaceful and have only amounted to a few people gathering outside on a nightly basis.
