A unanimous ruling from a three-judge panel on the very conservative and fascist 5th U.S. Circuit Court restricted access to one of the most common means of abortion in the U.S. by blocking the mailing of mifepristone prescriptions. Patients must now appear in person at a clinic in order to obtain this medication, thus overruling regulations set by the federal Food and Drug Administration.
During the COVID-19 pandemic, the Food and Drug Administration under President Joe Biden temporarily eliminated a requirement for mifepristone to be dispensed only in clinics, medical offices and hospitals. The change was made permanent in 2023.
Louisiana challenged that FDA regulation in federal court last year, alleging that it created safety risks and that the data to support it was flawed or nonexistent.
On Friday night, Danco Laboratories, which makes and distributes mifepristone, filed for a one-week stay — or pause — on the court’s order. The ruling will likely be appealed to the Extreme Court.
