Supreme Court lets Trump move forward with firing thousands of federal workers
The U.S. Supreme Court on Tuesday allowed the Trump administration’s firing of 16,000 probationary federal employees to go forward, at least for now.
In an unsigned opinion and without addressing the question of whether the terminations themselves were lawful, the court said the nonprofits that brought the case did not have legal standing to sue over federal employees’ firings.
The vote was 7 to 2. Justices Sonia Sotomayor and Ketanji Brown Jackson would have kept the firings paused while the case plays out in the lower courts, according to the order.
The court’s narrow ruling applies only to the nonprofits in Tuesday’s lawsuit, and it did not decide on the case as a whole. Nonetheless, the court’s decision makes it more difficult for groups affected by government layoffs to challenge mass firings systematically.
Supreme Court on Alien Enemies Act
The Supreme Court threw out U.S. District Judge James Boasberg’s decision to block the removal of men alleged to be members of a Venezuelan gang to El Salvador without any legal process under the Alien Enemies Act. The 5-4 ruling, with conservative Justice Amy Coney Barrett joining three liberal justices in dissenting, means the Trump administration can try to resume deportations under the rarely used wartime law, so long as detainees are given time to challenge their detentions and whether the Alien Enemies Act is being lawfully applied.
Both sides claimed a level of victory. Attorney General Pam Bondi, in a post on X, said Boasberg was an “activist judge” who didn’t have the authority to overrule “President Trump’s authority to conduct foreign policy.” Lee Gelernt, lead attorney for the ACLU who argued on behalf of the plaintiffs, said it was a “big victory” that the Supreme Court demanded the government give detainees due process.
The Supreme Court’s decision, however, leaves various legal questions unanswered about the novel invocation of the 18th century law, including whether the Trump administration can even invoke it against gang members.

IRS reaches data-sharing deal with DHS to help find undocumented immigrants for deportation
The Department of Homeland Security and the Internal Revenue Service finalized an agreement Monday to provide sensitive taxpayer data to federal immigration authorities as part of President Donald Trump’s deportation push, according to court filings.
As part of the deal, the IRS agreed to turn over information about undocumented immigrants who DHS says are already facing deportation orders and are under federal criminal investigation, including for the crime of failing to leave the country, according to the filings.
Treasury Secretary Scott Bessent and Homeland Security Secretary Kristi Noem signed the agreement. CNN reported last month that the IRS was nearing a deal to help Immigration and Customs Enforcement track down undocumented immigrants for possible deportation.
